Michelle Mitchell
Michelle Mitchell is a litigation attorney who has been in practice since 2002. Over the past six years, Ms. Mitchell has taken and defended over 100 depositions, participated in approximately 20 mediations and numerous trial and arbitral proceedings. Ms. Mitchell’s trial experience includes matters where she has served as lead counsel as well as numerous cases where she has second chaired trials in both State and Federal Court with some of San Diego’s most respected trial lawyers. In each of these matters she played a significant role in the discovery, trial preparation and trial. Ms. Mitchell has participated in all aspects of trial from discovery and trial preparation to trial motions, examination of witnesses, preparation of experts and trial and post trial motions.
Ms. Mitchell graduated from California Western School of Law in 2002 and then began her career as an associate in the law firm of Larabee & Gruenberg where she worked on a wide array of commercial and personal injury matters. During her tenure with Larabee & Gruenberg Ms. Mitchell second-chaired an employment law trial that involved a number of issues including a non-compete clause, injunctive relief and intellectual property rights and which resulted in a defense verdict for their client. Ms. Mitchell was extensively involved in both the discovery and the trial of the case; prepared all of the percipient witnesses for trial, and handled the direct examination of the defense witnesses.
Ms. Mitchell next joined the McClellan Firm where she worked for four years, litigating a wide array of cases from business litigation to personal injury matters. While at The McClellan Law Firm Ms. Mitchell was the lead associate and was responsible for own cases including multi-party litigation. Ms. Mitchell second-chaired a trial with John Gomez. before Hon. William C. Pate (Ret.) which resulted in a favorable outcome. Ms. Mitchell spent four weeks in trial with Craig McClellan, before Hon. Oliver W. Wanger, in a wrongful death case and was responsible for drafting and arguing the pre-trial motions in limine, preparing direct and cross-examination of percipient and expert witnesses and presenting witness testimony, deposing all experts as well as primary responsibility for discovery (taking and defending more than 20 pretrial depositions).
